Town of Copake, NY: zoning for new construction

8 districts Min residential lot 0.69–3 ac NYSEG

Copake zones most of its land Rural Residential at a 3-acre minimum with 20% coverage, and the two lake districts, Copake Lake and Chrysler-Rhoda-Snyder Ponds, carry that same 3 acres, so waterfront here isn't the small-lot situation people tend to expect. The hamlet district is the exception at about 0.69 of an acre. Local Law No. 11 of 2023 took effect April 1, 2024 and requires an operating permit for every short-term rental, with an enhanced permit once you rent more than 120 days a year, and that 120-day line is the number a rental pro forma should be built around. NYSEG serves the power, you're on septic, and the Building Department is at (518) 329-1234.

Rural Residential - The three acre lot size is an average, not a floor: lot sizes may be averaged across a subdivision so individual lots vary, provided the average in RU is three acres and Department of Health standards for conventional septic systems and private wells are met.

  • A major subdivision must also meet the flexible lot subdivision requirements of § 232-17.
  • Lot shape is capped as well: the ratio of lot width to lot depth may be no more than 1:3.
  • The coverage cap counts impervious surfaces, not just buildings, so driveways and paving eat into it.

Hamlet - With public or community sewer available, the lot minimum drops to 0.5 acre, with 50 ft of width, a 15 ft side yard, a 40 ft rear yard and 50% coverage. The figures shown are for a lot without sewer, where the minimum is 30,000 sq ft.

  • The front yard is at least 20 ft and at most 50 ft.
  • Coverage includes impervious surfaces, not just buildings.
  • The maximum ratio of lot width to lot depth is 1:3.

Hamlet Business - The lot minimum can drop to 0.5 acre as a density bonus (§ 232-18) where the applicant provides alternative septic systems and best site design practices under § 232-8B.

  • The front yard is at least 20 ft and at most 50 ft.
  • Coverage includes impervious surfaces, not just buildings.
  • The maximum ratio of lot width to lot depth is 1:3.

Highway Business, Mixed Use - Coverage includes impervious surfaces, not just buildings.

  • The maximum ratio of lot width to lot depth is 1:3.

Copake Lake - The lot minimum can drop to 2 acres as a density bonus (§ 232-18) that requires best site design standards but not an alternative septic system.

  • Coverage includes impervious surfaces, not just buildings.
  • The maximum ratio of lot width to lot depth is 1:3.

Chrysler-Rhoda-Snyder Ponds - In a minor subdivision the lot minimum can drop to 2 acres as a density bonus (§ 232-18) where the applicant provides alternative septic systems and best site design practices under § 232-8B.

  • A major subdivision must meet the flexible lot subdivision requirements of § 232-17.
  • Coverage includes impervious surfaces, not just buildings.
  • The maximum ratio of lot width to lot depth is 1:3.

Taconic Shores - No further subdivision of lots is allowed in TS.

  • Coverage includes impervious surfaces, not just buildings.
  • The maximum ratio of lot width to lot depth is 1:3.
