What the Copake code says
An ADU is allowed in any district on the Building Inspector's approval alone, with no site plan review or special use permit, if the applicant certifies it will be used only for nontransient occupancy for five years after its certificate of occupancy.
Conditions the code attaches:
- A certified ADU may not be used for transient or short-term rentals, and cannot get a short-term rental permit, during those five years.
- Without the certification, an ADU needs site plan approval from the Planning Board, and in MU a special use permit from the ZBA as well.
- It must be inside a one-family dwelling or its accessory building, at least 500 sq ft and no larger than two-thirds of the principal dwelling's total square footage.
- It may have no more than two bedrooms, needs separate access, and must have bathroom facilities equal to one full bath.
- An ADU in an accessory structure, or one that expands or alters the exterior of an existing building, must meet the district's dimensional requirements.
- There is no owner-occupancy or kinship rule; the five-year certification limits only transient and short-term rentals.

Rural Residential - The three acre lot size is an average, not a floor: lot sizes may be averaged across a subdivision so individual lots vary, provided the average in RU is three acres and Department of Health standards for conventional septic systems and private wells are met.
- A major subdivision must also meet the flexible lot subdivision requirements of § 232-17.
- Lot shape is capped as well: the ratio of lot width to lot depth may be no more than 1:3.
- The coverage cap counts impervious surfaces, not just buildings, so driveways and paving eat into it.
Hamlet - With public or community sewer available, the lot minimum drops to 0.5 acre, with 50 ft of width, a 15 ft side yard, a 40 ft rear yard and 50% coverage. The figures shown are for a lot without sewer, where the minimum is 30,000 sq ft.
- The front yard is at least 20 ft and at most 50 ft.
- Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
Hamlet Business - The lot minimum can drop to 0.5 acre as a density bonus (§ 232-18) where the applicant provides alternative septic systems and best site design practices under § 232-8B.
- The front yard is at least 20 ft and at most 50 ft.
- Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
Highway Business, Mixed Use - Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
Copake Lake - The lot minimum can drop to 2 acres as a density bonus (§ 232-18) that requires best site design standards but not an alternative septic system.
- Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
Chrysler-Rhoda-Snyder Ponds - In a minor subdivision the lot minimum can drop to 2 acres as a density bonus (§ 232-18) where the applicant provides alternative septic systems and best site design practices under § 232-8B.
- A major subdivision must meet the flexible lot subdivision requirements of § 232-17.
- Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
Taconic Shores - No further subdivision of lots is allowed in TS.
- Coverage includes impervious surfaces, not just buildings.
- The maximum ratio of lot width to lot depth is 1:3.
ADUs vs. short-term rentals in Copake
Short-term rentals allowed with local rules for Town of Copake. Short-term renting is regulated here. An operating permit is required for every short-term rental, and renting out more than 120 days in a year calls for an enhanced permit. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
