Columbia County
Town of Germantown, NY: zoning for new construction
Germantown zones the river side of the county in seven districts, from Natural Resource at a 10-acre minimum down to about half an acre in Hamlet Commercial, with the hamlet residential and mixed-use districts at an acre and coverage running from 35% up to 80%. An accessory apartment is a special permit in six of the seven and prohibited only in Business Development, and it is one of the more usable versions in the county, because a detached unit is allowed, it is capped at 800 square feet, and it does not count against the district's density, though adequate septic or sewer is an absolute precondition. Short-term rentals are an open question here rather than a yes or a no - the zoning law as published carries no short-term rental provision, a separate local law was drafted and its status is unsettled, and none of that adds up to permission. It is one phone call to the town at (518) 537-6687, and it is worth making before you count on rental income.

Zoning districts
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Natural Resource | 10 ac | 100 / 50 / 50 ft | 35 ft | Special permit |
| Agriculture Residential | 3 ac | 75 / 20 / 40 ft | 35 ft | Special permit |
| Rural Residential | 2 ac | 50 / 20 / 50 ft | 35 ft | Special permit |
| Hamlet Residential | 1 ac | 20 / 10 / 30 ft | 35 ft | Special permit |

| Business Development | 1 ac | 75 / 25 / 30 ft | 35 ft | No |
Natural Resource - The 100 ft front yard is a minimum only, with no maximum set, so a house may sit farther back from the road.
Agriculture Residential - The 75 ft front yard is a minimum with no maximum, so a house may sit farther back from the road than that figure without a variance.
- Confirm how the front yard is measured, and any other site constraints, with the building department before designing to these figures.
Rural Residential - Side yards must total 60 ft even though one side needs only 20 ft, so a building cannot sit at the one side minimum on both sides of the lot.
- The 50 ft front yard is a minimum only, with no maximum set, so the house can sit further back from the road.
Hamlet Residential - The front yard is a range, 20 ft minimum and 40 ft maximum, so a house has to sit within that band rather than anywhere behind the front line. The figures shown apply to lots without public sewerage.
- With public sewerage the minimum falls from one acre to 7,500 sq ft of lot plus 2,500 sq ft for each dwelling unit, so a single-family lot is 10,000 sq ft, under a quarter of the unserviced acre.
- The 35% coverage cap governs impervious surface as well as building coverage, so driveways and patios count against it.
Hamlet Mixed Use - The front yard is capped at 20 ft as a maximum, with the minimum set at 0 ft or the average of the adjacent front yards. The 1 acre minimum lot size is the residential figure where there is no public sewerage.
- With public sewerage the residential minimum falls from one acre to 5,000 sq ft of lot plus 2,500 sq ft per dwelling unit.
- Schedule B states a minimum lot area of 0 square feet, or 0 acres, for a nonresidential use here, which is the schedule's own figure rather than a missing value.
- The 80% coverage cap governs impervious surface as well as building coverage.
- No minimum lot width is set for this district.
Hamlet Commercial - The front yard here is a range, not just a minimum: buildings must sit at least 25 ft back but no more than 50 ft from the front lot line.
- The 50% coverage cap governs impervious surface as well as building coverage.
Business Development - If a nonresidential use abuts NR, AR, RR or HR, the side yard on that side and the rear yard both jump to 150 ft, far beyond the figures shown. A neighboring district can therefore reshape the buildable area of this parcel.
- The one-acre minimum lot size applies to residential and nonresidential uses alike.
- The coverage cap governs impervious surface as well as building coverage, so paving and parking count against it.
- The 75 ft front yard is a minimum, with no maximum set.
Short-term rentals
Short-term-rental status not confirmed. Short term rental rules here are not confirmed. A short term rental local law was proposed in 2023 and revised in 2024, but its adoption is unsettled, so confirm with the building department before counting on renting a home short term.
Conditions the code attaches:
- Ask the town whether Local Law C of 2023 was adopted; the building department can be reached at (518) 537-6687 before you list.
- The zoning and subdivision law as published contains no short term rental provision, so it does not settle the question.
- New York State's 2025 short term rental registry (Ch. 99 of the Laws of 2025) requires every host statewide to register the unit, regardless of local law.
