| Residence | 0.92 ac | 50 / 25 / 30 ft | 35 ft | No |
Residence - The minimum lot area is net, not gross, and a separate hundred feet of street frontage is required on top of the lot width shown, which is measured at the front yard line rather than at the street.
- A neighbourhood house of worship needs less land than a house: 32,670 square feet of net lot area, 0.75 acre, against the 40,000 square feet a dwelling needs.
- The Planning Board may cut the frontage to 50 feet at subdivision for a lot on a cul-de-sac or a street whose centre line curves at a radius of a hundred feet or less.
- The front setback runs from the edge of the right-of-way; where that is narrower than 50 feet, the building must stand back from the centre line by the front yard plus 25 feet.
- On a corner lot every yard abutting a street is a front yard, so the lot has two front yards, two side yards and no rear yard.
- A lot of two acres or more with public sewer may be subdivided to create one flag lot per parent parcel, reached by a 25-foot strip held in fee by the rear owner.
- The 20% impervious cap counts all impervious surfaces against the net lot area, and no floor area ratio applies to a house; the ratio applies only to uses that need a special permit.
Short-term rentals
Short-term rentals prohibited. Short-term rentals are banned in the Village of Pomona under § 130-16V. A short-term rental is a dwelling unit let for 29 consecutive nights or less for money or other valuable consideration.
Conditions the code attaches:
- Under § 130-24 a violation is punishable by fine, each short-term rental period offered counts as a separate offence, and the penalty escalates on the second.
- New York State's 2025 short-term rental registry separately requires every host to register the unit, whatever the local law says.
- Confirm with the Village of Pomona at (845) 354-0545 before listing.
