What the Providence code says
One apartment is allowed by right in an ancillary building on the lot, where that building's primary use is non-residential, such as a barn, shop or garage. It cannot go inside the house, in an addition, or in a purpose-built cottage.
Conditions the code attaches:
- Three acres per dwelling unit is required, and the apartment most likely counts as one, so a house and an apartment most likely need six acres.
- Ask the Code Enforcement Officer at (518) 882-6541 before relying on a three-acre lot.
- The apartment needs no permit and carries no condition on who may live in it.
- A commercial building of up to 3,000 square feet is separately allowed beside a house.
- Parts of the town inside the Adirondack Park may also need Adirondack Park Agency review, as a separate approval.
What the Providence code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Town-Wide | 3 ac | 50 / 25 / 25 ft | — | As of right |
Town-Wide - Providence has no zoning districts, and these figures apply to every parcel in the town. A lot with dwelling units needs at least three acres per dwelling unit, so two units need at least six acres and three at least nine.
- Frontage is measured along an existing public or private street line, and rises to 300 ft for any lot with three or more dwelling units.
- A lot that does not abut a road but has access to one must instead be at least 250 ft wide, with an access road at least 25 ft wide.
- The front lot line is the part of the lot with the greatest road frontage, which on a corner or through lot decides which yard takes the 50 ft setback.
- The law sets no height limit and no lot coverage. Height is constrained only by the New York State Uniform Code and, inside the Park, by the Adirondack Park Agency.
- Each lot takes one principal building, but § 2B(3) allows a commercial building of up to 3,000 sq ft beside a residential building on the same lot. A barn or similar outbuilding does not count as one.
- North of the blue line the Adirondack Park Agency must also approve subdivisions, commercial undertakings and anything touching a wetland, and its acreages are density guidelines, not lot minimums.
ADUs vs. short-term rentals in Providence
No local short-term-rental law on record - which is not the same as permission for Town of Providence. The Town of Providence has no local short-term rental law, and that is not the same as permission: the Town Board can legislate at any time. Confirm in writing with the Town before counting on short-term rental income. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.

Permission is one question and budget is another.
