What the Maybrook code says
An accessory dwelling unit is not permitted in any district of the Village of Maybrook. The only route to a second unit in the residence districts is converting an existing single-family detached house for two families, by special exception in RM-1 only.
Conditions the code attaches:
- The code defines an accessory apartment (§ 210-2B), but it is not a permitted or special exception use in any district.
- The conversion carries neither a size cap nor an owner-occupancy condition, so it makes two co-equal units rather than an accessory one.
- Dwelling units over first-floor nonresidential uses are permitted by right in the Downtown Design district and by special exception in B-2.
- In B-4, I-1, I-2 and I-3 a caretaker's or owner's dwelling unit is accessory only to a business or industrial use, not to a house.

Residential Agriculture 1-Family - Beyond the lot width, a lot here must have 80 ft of frontage. On a corner lot, the yard on the street side must be 35 ft.
- An accessory building may cover up to 20% of the required rear yard.
- An accessory building in the rear yard may stand no more than 18 ft high.
- An accessory building must sit at least 5 ft from any lot line.
Residential 1-Family - Lot frontage must be at least 80 ft, a standard separate from the 70 ft lot width shown. Side yards must add to 25 ft for the pair, so if one side is held to the 10 ft minimum, the other has to carry 15 ft.
- On a corner lot, the side yard on the street side must be 30 ft.
- An accessory building may cover up to 25% of the required rear yard and stand no more than 18 ft high there.
- An accessory building must sit at least 3 ft from any lot line.
- The 8,000 sq ft lot area is also the land required for each dwelling unit.
Residential 1-Family - On a corner lot, the side yard on the street side has to be 30 ft. Lot frontage is a separate 80 ft requirement that applies alongside the 90 ft lot width.
- An accessory building may cover up to 25% of the required rear yard.
- An accessory building in the rear yard may stand no more than 18 ft high.
- An accessory building must sit 3 ft from any lot line.
Residential 1-Family - Lot frontage must be at least 80 ft, a standard separate from the 50 ft lot width shown. On a corner lot, the side yard on the street side is 25 ft.
- An accessory building may cover up to 35% of the required rear yard.
- An accessory building in the rear yard may stand no more than 20 ft high.
- An accessory building must sit 3 ft from any lot line.
Multifamily Residential - Density, not lot size, binds here: 5,000 square feet of land is required for every dwelling unit. A dwelling that is not multifamily takes the R-4 standards instead, starting at 8,000 square feet of lot on 70 ft of width.
- Under those R-4 standards, a non-multifamily dwelling needs 30 ft front and rear yards, 25 ft for both side yards together, and is held to 35 ft of height and 30% building coverage.
- Lot frontage is a separate 80 ft standard, alongside the lot width.
- On a corner lot, the side yard on the street side is 25 ft.
- A single-family attached dwelling that already existed on 12 April 2004 is instead held to 2,000 square feet of lot with public sewer and water, and 2,000 square feet per dwelling unit.
- An accessory building may cover up to 35% of the required rear yard, stand no more than 20 ft high there, and must sit 3 ft from any lot line.
Senior Citizens Residential - Lot frontage is a separate 80 ft standard alongside the 50 ft lot width, and once the five acre site minimum is met it is the 2,900 sq ft of land required per dwelling unit that sizes the building.
- On a corner lot, the side yard on the street side must be 25 ft.
- An accessory building may cover up to 35% of the required rear yard.
- An accessory building in the rear yard may stand no more than 20 ft high and must sit 3 ft from any lot line.
- The table publishes no rear yard figure for this district, so confirm that yard with the building department.
Village Business - A multifamily building here is held to the RM-1 standards instead of the business ones: 5,000 square feet of lot, 5,000 square feet per dwelling unit, 50 ft of width, 25 ft front and rear yards, 25 ft of height and 35% coverage.
- The 12 ft side yard applies only if a side yard is provided, so a side yard is optional here and the 20 ft rear yard is the only yard that always binds.
- The lot area, lot width, front yard and combined side yard rows are published as none required, which is what lets buildings go to the street line and to the side lot lines.
- For a multifamily building, the two side yards together must reach 15 ft, with 10 ft on one side.
- Outside multifamily, each dwelling unit takes 2,500 square feet of land.
- No separate rear yard coverage or height limit applies to accessory buildings.
Highway Commercial - A senior citizen development in B-4 is held to the R-SC standards instead of the commercial ones: a five acre site and 2,900 square feet of land per dwelling unit. On a corner lot, the side yard on the street side is 50 ft.
- For a senior citizen development, the figures are 50 ft of lot width, a 50 ft front yard, 10 ft on one side and 15 ft for both side yards, two storeys and 35% building coverage.
- No rear yard figure is published for a senior citizen development in this district.
- Accessory buildings are not subject to a rear yard coverage limit or a height limit here.
Village Industry - Side yards are not mandatory here: the 12 ft figure applies only if a side yard is provided, and where both exist they must total 20 ft. No front yard is required, so buildings can sit on the street line.
- No side yard is required on a corner lot.
- No rear yard coverage limit and no height limit apply to accessory buildings.
Business Shopping Center - On a corner lot, the side yard on the street side must be 125 ft. Accessory buildings carry their own limits here on coverage, height and distance from lot lines.
- An accessory building may cover no more than 10% of the required rear yard.
- An accessory building may stand no more than 15 ft high.
- An accessory building must sit 65 ft from any lot line.
Traditional Downtown Design - A building must come to the street here: there is no minimum front yard, but the building can sit no more than 20 ft back and no less than 12 feet from the curb line. A single-storey building does not meet this district, which sets a minimum height of 20 ft in two storeys.
- Side yards are optional, but any side yard that is provided must be at least 10 feet.
- On a corner lot, the building must stand at least 12 ft from the curb line on the street side.
- No lot width is required.
- The floor area ratio of 2.0 applies in TDD and nowhere else in the village, alongside the 80% building coverage cap.
- The rest of the district's regulations are set out in § 210-7.5.
