What the Pleasantville code says
An accessory apartment is allowed by special permit on a one-family lot in RRR, RR, R and R-1, including a lot nonconforming as to bulk requirements, and the owner must live in one of the units as a principal residence (§§ 185-31A, 185-32A, 185-32B).
Conditions the code attaches:
- The Village issues no more than 50 accessory apartment special permits; legalized preexisting units and other legally existing apartments do not count against that limit (§ 185-33A).
- The Planning Commission must deny a permit if three other such permits or approvals have already been issued within a 500-foot radius of the lot's property lines (§ 185-33B).
- The apartment must be in the principal dwelling, in a portion that has existed at least 10 years before the application, and garage space may not be used (§ 185-32D).
- At least 250 sq ft of livable floor area and no more than 25% of the dwelling's gross floor area, not counting roof, cellar, garage, home-occupation or under-10-year space; at most two bedrooms.
- Parking follows Schedule VII of § 185-36, and the Planning Commission may not allow it in the required front yard.
- Westchester County Department of Health approval of water supply and sewage disposal is needed where the Building Inspector determines it applies.
