What the Dobbs Ferry code says
In OF1, OF2, OF3, OF4, OF5, OF6, MDR1, MDR2 and MDRH, the Planning Board may grant a special permit for an accessory dwelling unit, and the owner must live in the house or the ADU as a principal residence (§ 300-39B(3)). The Village caps ADU special permits at 50.
Conditions the code attaches:
- In MDR1, MDR2 and MDRH the unit may go only in an accessory building on a lot with a principal one-family dwelling; elsewhere it may be in the house or a permitted accessory building.
- The special permit must be transferred on a change of ownership, and it expires automatically if the new owner does not apply (§ 300-39D).
- The unit must be at least 300 sq ft and is capped at the lesser of 33% of the principal dwelling or 800 sq ft unless the Planning Board waives it, with no more than two bedrooms.
- The ZBA may not vary the cap of 50 permits (§ 300-39B(12)), so confirm the current count before relying on one.
- Westchester County Health Department approval of water supply and sewage disposal is required before a building permit issues.
- An ADU is prohibited in MF1, MF2, MF3, MF4, B, DB, DT, DG, EI, WFA, WFB and CP, and the rule in OS is not confirmed.
