What the Esopus code says
An accessory dwelling unit is permitted by right in RF-1, RF-2, R-40, R-12, RG, NC and BC: inside or attached to the house, or freestanding where the lot is at least twice the district minimum. 400 to 750 sq ft and never larger than the house.
Conditions the code attaches:
- The lot has to have a detached one-family dwelling as its principal use; a lot occupied by a two-family, apartment, townhouse or condominium does not qualify.
- Only one accessory unit is allowed per lot, and it cannot be sold separately from the main house.
- The unit must be at least 400 square feet, no larger than 750 square feet or the livable floor area of the house, whichever is less, and no more than two bedrooms.
- A freestanding unit is allowed on a building permit only where the lot is at least twice the district's minimum lot size.
- On a smaller lot a freestanding unit needs site plan approval from the Planning Board.
- The building inspector may refer even a by-right unit to the Planning Board for site plan review where the proposal raises site design concerns.
- The unit cannot be used as a short-term rental for five years from the date its certificate of occupancy is issued.
- A freestanding unit is limited to 15 feet in height and 45 feet in length and cannot stand in a required front yard.
- One off-street parking space is required, and the water supply and sewage disposal method must be approved before the building permit is issued.
How big an ADU can be in Esopus

ADUs vs. short-term rentals in Esopus
Short-term rentals allowed with local rules for Town of Esopus. Short-term rental is a defined and regulated use in Esopus. § 123-61 splits it into owner-occupied and non-owner-occupied short-term rental, and which form is allowed on a given parcel, and whether a permit is needed, are not confirmed. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both. Municipal source
