Rural Conservation - A home here needs 5 acres on a lot 250 feet wide, set back 75 feet at the front, 50 feet at the rear and 40 feet on the narrower side, with 100 feet for both sides together. Buildings cover up to 5% of the lot and reach 35 feet.

  • A 2-family dwelling takes 10 acres instead, and keeps the same 250 foot width and the same 75, 100, 40 and 50 foot yards.
  • Lot area is counted after water surface, state designated wetlands with a 100 foot buffer, rights-of-way, utility easements and 50% of any floodplain land come out of it.
  • An average slope of 11% to 20% adds 50% more land, 21% to 30% adds 100% more, and over 30% adds 200% more.
  • That slope surcharge is lifted for a lot holding a contiguous area of at least 80,000 square feet at 10% slope or less wholly inside the setback lines.
  • No building may stand within 75 feet of the center of the travelled way of a street, or within 20 feet of any lot line of an irregular lot.

  • Lot area is counted after water surface, state designated wetlands with a 100 foot buffer, rights-of-way, utility easements and 50% of any floodplain land come out of it.

ADUs vs. short-term rentals in Neversink

No local short-term-rental law on record - which is not the same as permission for Town of Neversink. As of June 2026 the Town of Neversink has no local short-term rental law. That is not the same as permission, so confirm with the building department before counting on renting short term. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
