What the Victory code says
An accessory apartment is available in SF-1, SF-2 and MUVC by special use permit, but only within a single-family dwelling: a detached unit, a garage conversion or a carriage house is not available here.
Conditions the code attaches:
- The principal dwelling must be owner-occupied, and there may be no more than one accessory apartment per parcel.
- Gross floor area may not exceed 750 sq ft, a flat cap with no percentage test, so a large house gets no more than a small one.
- No more than two individuals may live in any one accessory apartment, an occupancy cap written into the zoning law itself.
- The accessory apartment and the principal dwelling must share a common entrance, so a separate exterior door is not available; design to that from the first sketch.
- The unit must conform with the area and bulk requirements of the single-family residential districts, so in MUVC it is held to a stricter lot standard than the district's own.
- One off-street parking space must be provided, and no additional driveway is permitted, though an existing one may be widened or lengthened.
What the Victory code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Single-Family Residential 1 | 1 ac | 50 / 30 / 50 ft | 35 ft | Special permit |
| Single-Family Residential 2 | 0.28 ac | 30 / 20 / 30 ft | 35 ft | Special permit |
| Mixed Use Village Center | 0.21 ac | 25 / 15 / 15 ft | 35 ft | Special permit |
Single-Family Residential 1 - Every dwelling unit must also have a minimum horizontal dimension of 30 ft, excluding open porches, attached garages and other accessory structures, on top of the 1,000 sq ft floor area, which excludes most narrow infill and modular forms.
- Any accessory structure, building or garage, attached or detached, is limited to 900 sq ft and 15 ft of height, and may sit no closer than 10 ft to any side or rear property line.
- Only one garage, attached or detached, is permitted per residential lot.
- Where dwellings within 50 ft on either side and on the same block sit closer than the required front yard, it may be reduced to their average, but only on an area variance from the ZBA.
- A single-family dwelling is permitted by right and expressly does not include a manufactured home; an accessory apartment, a home occupation and a bed-and-breakfast need a special use permit.
Single-Family Residential 2 - Coverage is not the binding constraint here: on the 12,000 sq ft minimum lot the 35% cap allows a 4,200 sq ft footprint. The 100 ft of frontage and the 20 ft side yards are what bind.
- Every dwelling unit must also have a minimum horizontal dimension of 30 ft, excluding open porches, attached garages and other accessory structures, on top of the 1,000 sq ft floor area.
- The use list is word for word the same as SF-1's; the two residential districts differ only in their dimensions.
Mixed Use Village Center - This is the only district where more than one dwelling unit is possible: a two-family dwelling by right, and multi-family dwellings, townhouses and condominiums by site plan review rather than special use permit.
- The 9,000 sq ft lot figure carries no per-unit component and no separate multi-family standard, so on its face those uses sit on the same lot as a house, with unit count set through site plan review.
- Confirm that reading with the Code Enforcement Officer before underwriting unit count; it is the single most valuable open question on any Victory parcel.
- The 1,000 sq ft minimum dwelling and the 30 ft minimum horizontal dimension apply to every dwelling unit, which is a real constraint on townhouse widths.
- Any accessory structure, building or garage, attached or detached, is limited to 900 sq ft and 15 ft of height, and may sit no closer than 10 ft to any side or rear property line.
- Only one garage, attached or detached, is permitted per residential lot.
ADUs vs. short-term rentals in Victory
No local short-term-rental law on record - which is not the same as permission for Village of Victory. The Village of Victory has no local short-term rental law, and that is not the same as permission. Confirm the Village's position with the Code Enforcement Officer in writing before counting on short-stay income. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.

What an ADU costs to build in Victory
Permission is one question and budget is another. An 800 sq ft accessory unit here runs roughly $200k–260k at a standard finish, and the per-square-foot rate comes in above a full house because the kitchen, bath, panel and heating plant cost the same either way.
