What the Wesley Hills code says
The Village of Wesley Hills has no accessory dwelling provision under any name, and § 230-16B deems any use not specifically listed as permitted to be prohibited. That holds in R-50, R-35, R-20, R-15 and NS alike.
Conditions the code attaches:
- A lot may hold no more than one main building and its accessory buildings, except nonresidential buildings in districts where such uses are permitted (§ 230-14A), ruling out a backyard cottage.
- The only dwelling the use schedule permits in any district is a one-family detached dwelling.
- One roomer may be kept in a one-family detached dwelling as an accessory use, by right. It is not a separate dwelling unit, with no separate kitchen or certificate of occupancy.
- Confirm with the Building Department at (845) 354-0400.
What the Wesley Hills code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Residential R-50 | 1.15 ac | 50 / 30 / 50 ft | 25 ft | No |
| Residential R-35 | 0.8 ac | 50 / 25 / 50 ft | 25 ft | No |
| Residential R-20 | 0.46 ac | 40 / 25 / 40 ft | 25 ft | No |

Residential R-50 - A minimum effective square of a hundred and fifty feet a side must also fit inside the lot, a shape test on top of area and width. Lot width may drop to a hundred feet where the lot fronts a cul-de-sac or a street whose centre line curves at a radius of a hundred feet or less.
- Minimum lot frontage of 100 feet is a separate standard, and the Planning Board may reduce it for a lot on a cul-de-sac or a street curving at a radius of a hundred feet or less.
- An average-density lot needs at least forty thousand square feet, at least a hundred and twenty-five feet of width and ninety of frontage, with twenty-five-foot side yards and sixty for the pair.
- In an average-density subdivision of ten or more lots, a tenth of the lots may go down to thirty-five thousand square feet.
- Building coverage is the footprint alone; the impervious surface ratio adds drives, terraces and every other hard surface, and a separate ratio caps front-yard impervious surface at 0.15 in R-50.
- The height shown is the maximum building height; a larger maximum exposed building height of forty feet is allowed in the residential districts, measured where the ground falls away.
- Not more than a quarter of land under water, in a hundred-year floodplain, in a utility or other easement or right-of-way, or with unexcavated slopes over 25% may count toward the minimum lot area.
