An accessory apartment needs a special use permit in A-40, R-40, R-25, R-15, R-9, BL-O and H. The code sets no size cap, no owner-occupancy rule and no bar on renting it.

Conditions the code attaches:

It may be in or added to an existing single-family detached dwelling, or in a building accessory to it, so a garage or barn conversion is possible.
It must have its own cooking, eating, sanitation and sleeping areas, and it is not treated as a two-family dwelling.
The permit is judged on the general special use permit criteria of Article 8 and the district's own bulk rules.
One parking space is required per dwelling unit.
It is not permitted in IND-L, IND-H, B-15 or BL.
A two-family dwelling needs a special use permit in the same districts as the accessory apartment.
