What the Tuxedo Park code says
In A4, an accessory building that existed when Chapter 100 took effect may be used as a residence for guests or employees of the owner or tenant, on a permit from the Board of Zoning Appeals. A boathouse may never be used as a residence.
Conditions the code attaches:
- The guest-or-employee limit forecloses ordinary letting of the unit.
- No new construction qualifies, since the building must have existed as of the chapter's effective date.
- The accessory building and the principal building must each independently meet all Village laws and the New York State Uniform Fire Prevention and Building Code.
- Under § 100-16 no accessory building may be built unless a principal building stands on the same lot or on an immediately adjoining lot under the same ownership.
What the Tuxedo Park code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Four-Acre Single-Family Residence | 4 ac | 100 / 75 / 75 ft | 35 ft | Occupancy restricted |
| Gateway Overlay | — | 150 / - / - ft | 35 ft | Occupancy restricted |
Four-Acre Single-Family Residence - The four-acre minimum applies to lots created after Local Law No. 1-1987, and older lots keep smaller minimums. A square of 250 by 250 feet must fit inside a post-1987 lot, and 150 by 150 inside the smaller existing ones.
- An older lot needs at least two acres if it was already two acres or more, at least one acre if it was between one and two, and at least three quarters of an acre below that.
- Anything under an acre is unbuildable unless the Board of Zoning Appeals approves it.
- The village publishes no minimum lot width and controls lot shape through that square instead.
- Improved road frontage of at least 250 feet is required.
- A lot on the lake needs at least 250 feet of lake frontage and must stand at least a hundred feet back from the water.
- At least fifteen hundred square feet of the minimum floor area must be on the ground floor.
Gateway Overlay - This is an overlay on the village's residential zoning, not a base district, so a parcel here is still subject to the four-acre schedule of the district underneath.
- The 150-foot front setback is the one dimension the overlay itself fixes; read the other standards together with the underlying district.
ADUs vs. short-term rentals in Tuxedo Park
Short-term rentals prohibited for Village of Tuxedo Park. Short-term rentals are effectively banned: § 100-6 allows land to be used only for the purposes it lists, and a rental of under 30 days is not among them, so there is no permit to apply for. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
