Can you build an ADU in Florida, NY?
Village of Florida has 9 districts. All districts prohibit ADUs. Check your address to confirm the district that applies to your parcel:
What the Florida code says
The Village of Florida code makes no provision for an accessory dwelling unit in any district. In MR an existing house can be converted to three or more units by right, creating full dwellings rather than an accessory unit.
Conditions the code attaches:
- The MR conversion carries no owner-occupancy condition.
- A two-family dwelling is permitted outright in R-2 and MR and needs a special use permit in RO.
- In GC, a multifamily conversion needs a special use permit and puts dwellings in a mixed-use development over ground-floor commerce on at least three acres (§ 119-43(17)).
What the Florida code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Residential One-Family | 0.46 ac | 30 / 18 / 30 ft | 35 ft | No |
| Residential One- and Two-Family | 0.23 ac | 25 / 12 / 30 ft | 35 ft | No |
| Rural Residential | 0.92 ac | 40 / 20 / 50 ft | 35 ft | No |
| Residential Annexation | 1.84 ac | 65 / 40 / 65 ft | 35 ft | No |
| Residence/Office | 0.23 ac | 25 / 12 / 30 ft | 35 ft | No |
| Central Shopping | 0.23 ac | 0 / 0 / 0 ft | 35 ft | No |
| General Commercial | 1 ac | 25 / 15 / 25 ft | 35 ft | No |
| Industrial Park | 1 ac | 50 / 20 / 30 ft | 40 ft | No |
| Multifamily Residential | 5 ac | 40 / 30 / 30 ft | 35 ft | No |
Residential One-Family - The two side yards must add up to 45 ft, so meeting the 18 ft minimum on one side is not enough; the other side has to be wider than the minimum. Older undersized lots follow a separate standard.
- Existing small lots in any residence district are governed by § 119-8H.
- Each dwelling unit requires 20,000 square feet of land, the same as the minimum lot area.
- A dwelling must have at least 1,000 square feet of livable floor area.
Residential One- and Two-Family - Because only 5,000 square feet of land is required per dwelling unit, a two-family house can sit on the minimum 10,000 square foot lot here, which is not possible in the one-family district.
- Existing small lots in any residence district are governed by § 119-8H.
- Each dwelling must have at least 750 square feet of livable floor area, the smallest the Village asks.
Rural Residential - Existing small lots in any residence district are governed separately, under § 119-8H, rather than by the dimensions shown here, so an older undersized parcel may be buildable on different terms. Check with the building department before assuming a lot must meet the full figures.
Residential Annexation - Beyond the figures shown, a separate rule, § 119-8H, governs existing small lots in any residence district, so an older undersized parcel here may be treated differently.
- The 80,000 square feet of lot area is also the land required for each dwelling unit, so added units need added land.
- Check with the building department on how § 119-8H applies before relying on it for a specific parcel.
Residence/Office - The figures shown apply to residential use. A commercial use in RO takes 80 ft of lot width rather than 50, with a 12 ft side yard and a rear yard of only 10 ft instead of 30 ft.
- A commercial use keeps the same 100 ft lot depth and 25 ft front setback, and building coverage remains capped at 50%.
- No combined side yard figure is published for a commercial use, and the land per dwelling unit and minimum livable floor area standards do not apply to it.
- For a commercial use on a lot within 25 ft of a residence district boundary, the yards are set instead at 12 ft to the side and 5 ft to the rear.
- Existing small lots in a residence district are governed by § 119-8H.
Central Shopping - Buildings may come to the street and to neighbouring lots, but where a lot sits within 25 ft of a residence district boundary, 10 ft is required to the side and 5 ft to the rear.
- A multifamily conversion in this district falls outside the village's multifamily standards and is governed by § 119-43B(17) instead.
Multifamily Residential - The land required per dwelling unit climbs with bedroom count, from 3,500 square feet for an efficiency of one habitable room to 6,000 square feet for a three-bedroom or larger, so the unit mix, not the five-acre minimum, sizes the building.
- Attached single-family dwellings take more land per unit, not less: 4,800 square feet for a one-bedroom, rising to 6,800 for a two-bedroom and 10,500 for a three-bedroom.
- Attached single-family dwellings are held to different lot figures: 224 ft of width, 100 ft of depth, a 30 ft front yard and a 35 ft rear yard.
- For attached single-family dwellings the side yard is 0 ft, except that an end-row attached or townhouse dwelling needs at least 15 ft.
- Every attached dwelling must be at least 20 ft wide.
- A one-bedroom flat takes 4,000 square feet of land per unit.
- Multifamily conversions in the CS district are excluded from these standards.
ADUs vs. short-term rentals in Florida
No local short-term-rental law on record - which is not the same as permission for Village of Florida. The Village of Florida has no local short-term rental law, and that is not the same as permission. Confirm with the Village building department before counting on short-term rental income. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.

Permission is one question and budget is another.
