What the Brockport code says
No accessory apartment is allowed in O (O Residential Use District), the village's only residential district. The uses listed there do not include a second dwelling unit.
Conditions the code attaches:
- Not more than one dwelling shall be erected, placed or occupied on one lot (§ 58-9E).
- There shall be but one principal use of any one lot (§ 58-8A(4)).
- Accessory buildings and uses are limited to those that usually accompany and are part of a permitted use, along with a garage for up to two cars (§ 58-9A).
- A residence in which a bed-and-breakfast establishment is operated shall not contain an accessory apartment (§ 58-9A(9)(b)[5]).
- Code enforcement can be reached at (585) 637-5300 ext. 114 before planning any second unit.
What the Brockport code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| O Residential Use District | 0.23 ac | 30 / 10 / 30 ft | 35 ft | No |
O Residential Use District - The front yard is 30 ft or the average front setback of existing residences on the same street within 200 ft, whichever is greater (§ 58-9F(1)). Not more than one dwelling may be erected or occupied on one lot.
- The Board of Appeals may vary any yard depth or width wherever established yards within 200 ft differ from the chapter (§ 58-9F(6)).
- A lot already under 85 ft wide when the chapter was enacted has side yards modified in proportion to its width, one not less than 4 ft and the other not less than 11 ft (§ 58-9F(4)).
- A corner lot owes 30 ft along the side lot line next to the side street for the full depth of the lot.
- The Zoning Board of Appeals may permit building lots of 65 ft and above on application where smaller lots already exist nearby (§ 58-9H).
- Coverage counts one-family dwellings and their accessory structures together, so a detached garage uses the house's allowance.
- The floor area shown is for a one-storey house. A two- or three-storey house needs 700 sq ft on the ground floor, a split level 1,100 sq ft and a raised ranch 800 sq ft aboveground (§ 58-9I).
ADUs vs. short-term rentals in Brockport
Short-term rentals allowed with local rules for Village of Brockport. The only path to a paid short stay is an owner-occupied bed-and-breakfast in the O district, run as a home occupation under a special conditional use permit from the Zoning Board of Appeals. The owner must live there full time, so an investor-owned whole-house rental has no path. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both. Municipal source

Permission is one question and budget is another.
