What the Coxsackie code says

The village code has no accessory dwelling unit provision, so a second unit cannot be added as an accessory to a house. The route to a second unit is the two-family dwelling, a permitted principal use in MDR-1, MDR-2, MDR-3 and MR.

Conditions the code attaches:

Waterfront Recreation District - The 50 foot rear yard is measured from the high water line, not from the rear lot line, and the front yard is 10 feet from the street or 50 feet from the high water line, whichever applies.

  • That distance is measured 50 feet horizontally away from and paralleling the river, and a special use permit can allow a building closer to the high water line.
  • The coverage figure caps impervious surface, everything hard surfaced, rather than the building footprint alone.
  • Schedule C publishes no cap on the building footprint itself for this district.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.

Rural Residential Agriculture District - One side yard is 10 feet but both sides together must total 25 feet, so doubling the single figure falls short. The building may cover 20% of the lot and impervious surface 30% in total.

  • Accessory uses are limited to 10% of the lot within that 30% impervious total.
  • Lot density here is one dwelling unit per acre.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.
  • Areas of significant wildlife habitat, including landscape linkages and wildlife corridors, are also excluded.

Waterfront Residential District - The 50 foot rear yard is measured from the high water line, not from the rear lot line. A multifamily dwelling needs 2,200 square feet of land per unit, and a single-family attached or two-family dwelling 2,500 square feet per unit.

  • That distance is measured 50 feet horizontally away from and paralleling the river, and a special use permit can allow a building closer to the high water line.
  • The coverage figure caps impervious surface, everything hard surfaced, rather than the building footprint alone.
  • Those per unit figures are on top of the one acre minimum lot, not instead of it.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.

Medium Density Residential-1 District, Medium Density Residential-2 District, Medium Density Residential-3 District - There is no minimum front yard: a building is built to the sidewalk, to the average of the front yard setbacks on the block, or at most 10 feet back. The building may cover 25% of the lot and impervious surface 50% in total.

  • A building is built to the sidewalk, or to the average of the front yard setbacks on the block on the same side of the street, or at most 10 feet back, so there is no minimum front yard.
  • One side yard is 5 feet but both sides together must total 10 feet.
  • Accessory uses are limited to 10% of the lot within that 50% impervious total.

Mixed Residential District - There is no minimum front yard: a building is built to the sidewalk, to the average of the front yard setbacks on the block, or at most 10 feet back. A multifamily dwelling needs 1,500 square feet of land per unit and an attached or two-family dwelling 2,000.

  • Those per unit figures are on top of the 7,500 square foot (0.1722 acre) minimum lot, not instead of it.
  • One side yard is 5 feet but both sides together must total 10 feet.
  • The building may cover 35% of the lot, and the 60% figure caps impervious surface rather than the footprint.
  • Accessory uses are limited to 10% of the lot within that 60% impervious total.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.

Community Services and Recreation District - Maximum height here is 45 feet with no limit in stories, and the 70% figure caps impervious surface rather than the building footprint.

  • The side yard of 25 feet is deeper than the 12 foot rear yard in this district.
  • Schedule C publishes no cap on the building footprint itself for this district.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.
  • Areas of significant wildlife habitat, including landscape linkages and wildlife corridors, are also excluded.

Village Center District - There is no minimum front yard: a building is built to the sidewalk, to the average of the front yard setbacks on the block, or at most 10 feet back. The rear yard is 10 feet and the maximum height 50 feet.

  • A building is built to the sidewalk, or to the average of the front yard setbacks on the block on the same side of the street, or at most 10 feet back, so there is no minimum front yard.
  • A building that shares a party wall needs no side yard on that side; otherwise the side yard is 5 feet.
  • Impervious surface may cover 95% of the lot, and no cap on the building footprint itself is published.

Waterfront Development District - The 50 foot rear yard is measured from the high water line, not from the rear lot line, and the front yard is 10 feet from the street or 50 feet from the high water line, whichever applies.

  • That distance is measured 50 feet horizontally away from and paralleling the river, and a special use permit can allow a building closer to the high water line.
  • A building that shares a party wall needs no side yard on that side; otherwise the side yard is 5 feet.
  • Impervious surface may cover 90% of the lot, and no cap on the building footprint itself is published.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.

Neighborhood Commercial District, Community Commercial District - There is no minimum front yard: a building is built to the sidewalk, to the average of the front yard setbacks on the block, or at most 10 feet back. The 70% figure caps impervious surface rather than the building footprint.

  • A building is built to the sidewalk, or to the average of the front yard setbacks on the block on the same side of the street, or at most 10 feet back, so there is no minimum front yard.
  • Impervious surface may rise to 80%, but only by special permit, and only with proper stormwater management.
  • Schedule C publishes no cap on the building footprint itself for this district.
  • Density is calculated after excluding all water bodies, watercourses and wetlands from the land area.
  • Land of 50% slope or greater is excluded too, and half of all land with a slope over 15% and under 50%.

Industrial District - The front yard here is 40 feet and the rear yard 50 feet. The 70% figure caps impervious surface rather than the building footprint, and maximum height is 45 feet with no limit in stories.

  • Areas of significant wildlife habitat, including landscape linkages and wildlife corridors, are also excluded.

Planned Development District - No lot area, width, yard, height or coverage standard is published for this district. Its dimensions are set when the Village Board rezones land to it and approves the development, in place of the standards that apply elsewhere in the chapter.

  • Because the dimensions are fixed at rezoning, confirm what applies to a particular parcel with the village before relying on any figure.

ADUs vs. short-term rentals in Coxsackie

Short-term rentals allowed with local rules for Village of Coxsackie. Short term rentals require annual registration under the village's Local Law #4 of 2023, and registrations are capped by district, so availability can depend on how many are already registered. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
