What the Hamburg code says
An accessory dwelling unit is allowed only in LCR, NCC and GC, and only with a special use permit. It is prohibited in SFR, TVR and VCC, and MU-R and MU-I allow neither a house nor such a unit.
Conditions the code attaches:
- An owner must live in one of the two units at least six months a year and sign a notarised affidavit, which a new owner must renew on sale
- One unit per house, attached or detached, with no more than two bedrooms
- The unit can never be sold separately from the house
- Any new outside entrance must be at the side or rear, and the design must match the house
- A detached unit is held to the limits for accessory structures
What the Hamburg code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.

|---|---|---|---|---|
| SFR Single-Family Residential | 0.17 ac | 25 / 6 / 30 ft | 35 ft | No |
| TVR Traditional Village Residential | 0.14 ac | 25 / 6 / 30 ft | 35 ft | No |
| LCR Limited Commercial Residential | 0.14 ac | 15 / 6 / 30 ft | 35 ft | Special permit |
| Village Center Commercial District | 0.14 ac | 0 / 0 / 20 ft | 55 ft | No |
| Neighborhood Commercial Corridor District | 0.14 ac | 0 / 10 / 25 ft | 35 ft | Special permit |

| Mixed Use Industrial District | 0.46 ac | 0 / 15 / 35 ft | 40 ft | No |
Village Center Commercial District - There is a minimum building height here as well as a maximum: a multifamily or non-residential building must reach at least 30 ft and two storeys, and may then go to 40 ft and three storeys or 55 ft and four.
- For a non-residential use the only area control is a 7,500 sq ft cap on the footprint of a primary structure
- A zero side yard is not only allowed but encouraged where the principal building may abut its neighbour
- The front yard for a non-residential use is a build-to band of 0 to 10 ft rather than a minimum
- A structure originally built for residential purposes keeps the front yard and entrance of the original building whatever it is used for now
- The side and rear yards shown are the smaller of a pair, and the larger applies to a non-residential use adjacent to a residential use or district
Neighborhood Commercial Corridor District - The lot minimum depends on the use: a non-residential use needs 9,000 sq ft on a 45 ft width where a house needs 6,000 sq ft on the same width.
- The 50% cap is on gross impervious surface rather than building footprint
- A primary non-residential structure is separately capped at 7,500 sq ft of footprint, and that cap, not the coverage percentage, is what limits a large-format building
- The front yard for a non-residential use is a build-to band of 0 to 30 ft rather than a minimum
- A structure originally built for residential purposes keeps the front yard and entrance of the original building whatever it is used for now
- The side and rear yards shown are the smaller of a pair, and the larger applies to a non-residential use adjacent to a residential use or district
Gateway Commercial District - The lot minimum depends on the use: a non-residential use needs 15,000 sq ft where a house needs 10,000 sq ft.
Mixed Use Redevelopment District - A primary non-residential structure is capped at 10,000 sq ft of footprint, on top of the 40% cap, which is on gross impervious surface rather than building footprint.
- Accessory structures take 5 ft, rising to 10 ft on the same test
Mixed Use Industrial District - The 40% cap shown is on gross impervious surface rather than building footprint, and the front yard for a non-residential use is a build-to band of 0 to 30 ft rather than a minimum.
- The district sets no cap on the footprint of a primary non-residential structure
- A structure originally built for residential purposes keeps the front yard and entrance of the original building whatever it is used for now

Short-term rentals allowed with local rules for Village of Hamburg. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both. Municipal source

What an ADU costs to build in Hamburg
Permission is one question and budget is another.
