What the Pawling code says
An accessory dwelling needs a Planning Board special use permit in R1, R2, R3, R4 and B2 and is not allowed in B1 or I1. The owner must live in the house or the unit as a primary residence, and the permit is void once ownership or the owner's residence changes.
Conditions the code attaches:
- The unit must be in an accessory structure to a single-family dwelling, and the part used for it must be at least 450 and at most 500 sq ft.
- Bedrooms are limited to one, and no more than two persons may live in the unit at a time.
- The permit is granted only to single-family residences with at least 1,200 sq ft of floor area, not counting garage and accessory structures.
- Only one dwelling unit in the structure, and no more than one per single-family dwelling.
- The permit runs two years at a time, renewable without a new application if the Building Inspector finds no material change and a renewal fee is paid; if it expires, the use must cease.
- A new owner must apply to the Planning Board again.

ADUs vs. short-term rentals in Pawling
No local short-term-rental law on record - which is not the same as permission for Village of Pawling. As of June 2026 the Village of Pawling has no local short-term rental law, which is not the same as permission to rent short term. Confirm with the Village Clerk before counting on the use. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
