What the Rhinebeck code says
An accessory dwelling unit needs a special use permit and site plan approval in HP20, RA10, RC5, RL5 and RM1, where the owner has to live in one of the two units. No second unit is permitted in BP, CRB, CBN, CBS, GWN, GWE, GWS, GB, ORP, LC, CIV, CIV2 or WH.
Conditions the code attaches:
- Inside the house the unit can be no more than 35% of the home's habitable space or 1,000 sq ft (650 sq ft in RM1), whichever is smaller.
- A detached unit is capped at 650 sq ft in RM1, 900 sq ft in RL5, RC5 and RA10, and 1,200 sq ft in HP20.
- For a unit inside the house the permit is void if the owner lives somewhere else for more than six months.
- A conversion to two-family needs a house that legally existed when the zoning law was adopted and a recorded deed rider keeping one unit owner-occupied permanently.
- Up to three accessory units in all, by converting outbuildings that existed when the zoning law took effect and if the lot meets the density; four units need one affordable.
- No second unit may be added in WH, the workforce-housing district the Town Board maps onto land project by project by reclassifying it.
- New one-family, two-family and multifamily construction is permitted in WH, but only as an affordable housing development of at most 80 dwelling units, at least 80% of them affordable.
How big an ADU can be in Rhinebeck
Size limits are set per district, and a unit inside the house is a different standard from a detached one. These are the figures the code publishes.
35% of the principal dwelling, or 1,000 sq ft of habitable space — whichever is smaller
1,200 sq ft of habitable space
900 sq ft of habitable space
35% of the principal dwelling, or 650 sq ft of habitable space — whichever is smaller
650 sq ft of habitable space
1 other district allows an accessory unit but the code publishes no size for it here, so this page does not state one.

ADUs vs. short-term rentals in Rhinebeck
Short-term rentals allowed with local rules for Town of Rhinebeck. Short-term rentals in the Town of Rhinebeck fall under §§ 125-144 through 125-154 of Zoning Chapter 125, enacted by Local Law No. 2 of 2025. Those sections replaced the short-term rental article adopted in 2024, which was repealed. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
