What the East Fishkill code says
In R-3, R-2, R-1, R-1/3 and CRD an accessory apartment needs only a Building Department permit, the owner must live in one of the units, and a new owner must apply for renewal. It is not permitted in B-1, B-2, B-3, B-1A, HC, I-1, I-2, I-3, PCP or PRDP.
Conditions the code attaches:
- Inside the house the unit must be at least 400 sq ft and no more than 50% of the habitable floor space or 1,000 sq ft, whichever is less.
- In an outbuilding the unit must be at least 400 sq ft and no more than half the building, and meet the house's side and rear yards.
- No permit until five years after the certificate of occupancy for the house or outbuilding, and no footprint expansion over 100 sq ft.
- One apartment per lot, none in a two-family or multifamily dwelling, no renting of rooms, and a deed covenant barring accessory apartments defeats the right to one.
- On a conforming R-1, R-2 or R-3 lot of at least 10 acres with road access, one estate cottage is also permitted by right, owner-occupied.
- An estate cottage has two bedrooms, 600 to 1,500 sq ft and no more than half the house, and its septic must be certified.
How big an ADU can be in East Fishkill
Size limits are set per district, and a unit inside the house is a different standard from a detached one. These are the figures the code publishes.
At least 400 sq ft, and no more than 50% of the principal dwelling, or 1,000 sq ft of habitable floor space — whichever is smaller

ADUs vs. short-term rentals in East Fishkill
Short-term rentals allowed with local rules for Town of East Fishkill. Short-term rentals of 30 days or less are allowed only in single-family dwellings in certain residential districts, and are prohibited in R-1/2, R-1/3, R-1/4 and on non-conforming lots. Each needs annual registration with the Building Department and a $500 yearly fee. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
