What the Dover code says
An accessory apartment needs a Planning Board special permit in RU, RC, HM, HR, SR, HC and CO, and is prohibited in M. It must be inside an owner-occupied structure or in an accessory structure on an owner-occupied property.
Conditions the code attaches:
- One accessory apartment per single-family dwelling, in the principal building or an accessory structure as the Use Table provides (§ 145-12C).
- The lot must carry the minimum acreage required by the Dimensional Table.
- In mixed-use and commercial districts, each lot may have one apartment of up to 1,000 sq ft above a nonresidential use by right as an accessory apartment (§ 145-12B(5)); owner occupancy still applies.
- Building Department: (845) 832-6111.

ADUs vs. short-term rentals in Dover
No local short-term-rental law on record - which is not the same as permission for Town of Dover. As of June 2026 the Town of Dover has no local short-term rental law, and that is not the same as permission. Confirm with the Town of Dover Building Department before counting on short-term rental income. These are separate questions from whether you can build an ADU — a unit you're allowed to add isn't automatically one you're allowed to rent nightly, so check both.
