Zoning districts
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Residential Recreational | — | 30 / 20 / 40 ft | 25 ft | No |
| Single-Family Residential | — | 25 / 10 / 25 ft | 35 ft | No |
| Multiple-Family Residential | — | 25 / 10 / 40 ft | 40 ft | No |
| General Business | — | 50 / 25 / 50 ft | 40 ft | No |
| Mixed Use | — | 50 / 25 / 50 ft | 40 ft | No |
| General Industry | — | 50 / 25 / 50 ft | 45 ft | No |
Residential Recreational - R-R permits single-family dwellings only, with no two-family, multifamily or townhouse use, so a second dwelling unit cannot be added by any route. Lots are sized by width and depth, as the Village does not regulate lot area.
- In a subdivision of five or more dwellings each lot may fall to 16,000 sq ft, provided common or public space keeps an average of 25,000 sq ft per dwelling and the Board approves its maintenance.
- A house of worship needs 200 ft of width and 200 ft of depth, double a dwelling's width, and an animal hospital or a sand, gravel or stone extraction needs 300 by 300.
- On a street under 50 ft wide, the front yard is measured from the center line of the street and is 55 ft.
- The 75% coverage cap is qualified by a sentence saying floor area ratio determines lot coverage, but no ratio is stated in the district. Confirm with the building department.
- Lot width is measured at the building line. The separate minimum street frontage is 40 ft.
Single-Family Residential - The 70 by 100 ft lot applies with public water and public sewerage. With public water but individual sewerage the minimum is 90 by 100 ft, and with a private water system and individual sewerage it is 100 by 100 ft.
- A house of worship needs 200 by 200 ft regardless of utility service, nearly three times a dwelling's width.
- A two-family dwelling uses the same lot width and depth as a single-family dwelling, so a duplex needs no extra land.
- Townhouses and garden apartments need a special permit.
- On a street under 50 ft wide the front yard is measured from the center line and is 50 ft, and lot width is measured at the building line, with a separate 40 ft minimum street frontage.
- Lots are sized by width and depth, as the Village does not regulate lot area.
- Lot area averaging for single- or two-family dwellings is permitted only in a subdivision of two or more lots.
Multiple-Family Residential - Three-family, larger multifamily and townhouse development in R-M requires public water and public sewerage, so it cannot be built on an unserved lot of any size. The 60 by 100 ft lot is for a single- or two-family dwelling with both services.
- With public water but individual sewerage a single- or two-family lot jumps from 60 by 100 ft to 100 ft by 125 ft, roughly 2.1 times the land; an individual water system gives the same figure.
- The three-family row is 70 ft by 100 ft and needs public water and public sewerage; a four-family or larger is sized per dwelling unit at 80 ft of width by 100 ft of depth.
- On the face of the table a 6-unit building needs 480 ft of width, so confirm that reading with the Village before sizing anything above three units.
- A townhouse lot is 18 ft wide by 80 ft deep, the narrowest the Village allows, and needs public water and sewerage; it takes 25 ft front, 20 ft each side and a 50 ft rear yard.
- A house of worship needs 100 by 100.
- The side yard is 15 ft for a three-story dwelling, on the same 20 ft combined total for the two sides.
General Business - In B-G the side and rear yards apply only where the lot adjoins a residential district or an existing residence. A lot surrounded by commercial or industrial neighbours has no side or rear yard obligation.
- The district sets no minimum lot area, width or depth and no maximum lot coverage.
- On a street under 50 ft wide, the front yard is measured from the center line of the street and is 75 ft.
- No combined total for the two side yards is required.
- The height limit applies to dwellings as well as business buildings.
Mixed Use - Side and rear yards in M-U are required only where the lot adjoins a residential district or an existing residence, so a lot surrounded by commercial or industrial neighbours has no side or rear yard obligation.
General Industry - Side and rear yards in I-G apply only where the lot adjoins a residential district or an existing residence, so an industrial lot surrounded by industrial neighbours has no side or rear yard obligation. Height may exceed 45 ft if approved by the Board of Appeals.
- The district sets no minimum lot area, width or depth and no maximum lot coverage.
- On a street under 50 ft wide, the front yard is measured from the center line of the street and is 75 ft.
- No combined total for the two side yards is required.
Short-term rentals
No local short-term-rental law on record - which is not the same as permission. The Village of Walton has no short-term rental law, and § 260-4 prohibits uses its districts do not list; no district lists a short-term or vacation rental. The rule is not confirmed, so confirm with the building department before counting on STR income.
Conditions the code attaches:
- R-R and R-S list no transient lodging use. In R-M the only one is a resort, added by Local Law No. 4-2025 as a conditional use, with guest stays capped at no more than 30 days in any 90-day period.
- Hotels, motels, motor lodges and tourist homes appear in the B-G and M-U use lists, and bed-and-breakfasts in M-U only.
- Chapter 185, § 185-1 through § 185-7, requires registration of rental property. It is not a short-term rental law and grants no zoning permission.
- The Town of Walton's Chapter 192 transient rental permit does not apply to a parcel in the Village.
