What the Rensselaerville code says
An accessory apartment is allowed in every district on a special use permit from the Planning Board, and it may sit inside the house, attached to it, or in a separate accessory structure. The owner has to live in one of the two units, and may live in either.
Conditions the code attaches:
- Only one accessory apartment is allowed per single-family lot, either within the dwelling or in an accessory structure, but not in both.
- The apartment may be no more than 1,200 square feet and no less than 320.
- In an accessory structure the apartment may not exceed 50% of the total square footage of the principal dwelling.
- The interior version is limited to two bedrooms, and the lot may not be an existing nonconforming lot smaller than the required lot area or lot width.
- Two parking spaces per dwelling unit are required on site, outside any required yard or setback.
- Albany County Department of Health has to approve septic and water before the Planning Board approves, and the unit must connect to the principal dwelling's existing septic, water supply, or both.
What the Rensselaerville code indicates by district
The table below shows how each district treats ADUs, alongside the lot and setback standards that govern a second unit. District boundaries and conditions vary, so treat this as a starting point and confirm the district that applies to your parcel.
| District | Min lot | Setbacks F / S / R | Max height | ADU |
|---|---|---|---|---|
| Agricultural/Rural Residential | 5 ac | 50 / 50 / 50 ft | 35 ft | Occupancy restricted |
| Crystal Lake | 2 ac | 15 / 15 / 15 ft | 35 ft | Occupancy restricted |
| Hamlet | 0.5 ac | 15 / 15 / 15 ft | 35 ft | Occupancy restricted |
| Resource Conservation 1 | 15 ac | 50 / 50 / 50 ft | 35 ft | Occupancy restricted |
| Resource Conservation 2 | 15 ac | 50 / 50 / 50 ft | 35 ft | Occupancy restricted |
| Resource Conservation 3 | 15 ac | 50 / 50 / 50 ft | 35 ft | Occupancy restricted |
Agricultural/Rural Residential - A two-family needs no extra land here: it sits on the same five acres as a one-family, and a multi-family keeps the five acres and 250 ft of frontage while its side and rear yards drop to 30 ft.
- A mobile home needs a 75 ft front yard rather than 50 ft, with 30 ft side and rear yards, on the same five acres.
- A nonresidential use needs 300 ft of frontage rather than 250 ft, and its building footprint may not exceed 4,000 sq ft.
- Agriculture is exempt from the lot area, height, frontage and coverage limits; yard setbacks still apply.
- Density is limited separately from lot size, and a lot may not exceed a 1:4 width to depth ratio.
- For a dwelling, the front yard and the frontage here are the same whether the lot fronts a town or private road or a county or state road.
Crystal Lake - Where an existing lot with deeded Crystal Lake rights is under two acres, its setbacks become those allowed for a one-family dwelling in the Hamlet district. On a county or state road the front yard is 20 ft rather than 15 and frontage 100 ft rather than 80.
- A mobile home matches a one-family in every dimension except building coverage, which is 20% rather than 25%.
- A two-family needs no more land here than a one-family does.
- Density is limited separately from lot size, and a lot may not exceed a 1:4 width to depth ratio.
Hamlet - A two-family needs one acre here, twice the half-acre a one-family needs, on otherwise identical frontage, yards, height and coverage. A multi-family keeps the half-acre minimum but needs 150 ft of frontage, or 200 ft on a county or state road.
- A multi-family also takes 20 ft side and rear yards rather than 15 ft.
- A nonresidential use needs one acre and 120 ft of frontage with 30 ft side and rear yards, and its building footprint may not exceed 4,000 sq ft.
- On a county or state road the front yard is 20 ft rather than 15 ft and the required frontage is 100 ft rather than 80 ft.
- Agriculture is exempt from lot area, height, frontage and coverage entirely, and only the yards apply.
- A new agricultural structure outside a New York State certified agricultural district may not stand within the 100 ft stream setback.
- Density is limited separately from lot size, and a lot may not exceed a 1:4 width to depth ratio.
Resource Conservation 1, Resource Conservation 2 - The front yard here is the figure for a lot on a town or private road. A dwelling on a county or state road needs 75 ft in front rather than 50 ft, and a mobile home takes the 75 ft front yard whichever road it fronts.
- A nonresidential building takes a 40 ft front yard on a town road but 100 ft on a county or state road, and its footprint may not exceed 10,000 sq ft.
- Agriculture is exempt from the lot area, height, frontage and coverage limits; yard setbacks still apply.
- RC-1, RC-2 and RC-3 carry identical dimensions and differ in which uses are permitted, not in bulk.
- Density is limited separately from lot size, and a lot may not exceed a 1:4 width to depth ratio.
Resource Conservation 3 - The front yard here is the figure for a lot on a town or private road.
- RC-1, RC-2 and RC-3 carry identical dimensions and differ in which uses are permitted, not in bulk.
- Density is limited separately from lot size, and a lot may not exceed a 1:4 width to depth ratio.
